Guidelines for the Application and Registration of Digital, Virtual, Interactive and Short Message Services (SMS) Competitions, Games and Quizzes in Botswana

The Botswana Gambling Authority has introduced guidelines for the application and registration of digital, virtual, interactive and short message services (SMS) competitions, games and quizzes in gaming.

The notice is given in terms of Section 5(h) of the Gambling Act (Cap 19:03), which provides that the Authority shall regulate and control all gambling activities in Botswana. The guidelines are in support of this legal provision and provide a framework for entities to operate digital, virtual, interactive, and SMS competitions, games, and quizzes.

The guidelines aim to regulate gaming activities conducted electronically and via SMS platforms, providing a framework for operators to ensure compliance with laws and regulations.

According to the guidelines, all entities intending to conduct digital, virtual, interactive or SMS competitions, games and quizzes must apply for registration with the Gambling Authority.

The application process requires submission of a completed form, terms and conditions for the competition or game or quiz, proposal of how the competition will be conducted, and other supporting documents.

The guidelines also outline specific requirements for applicants, including the provision of information on how the competition will be conducted, how results will be determined, targeted participants, place and date of determining winners, details of prizes to be won, and system capability for determining winners.

Additionally, applicants must provide information on how participants will become subscribers to the competition or game or quiz.

The guidelines also specify conditions that must be fulfilled after approval and prior to the commencement of the competition, including ensuring compliance with all laws of Botswana and submitting proof that all proposed prizes have been purchased or are readily available.

The application fee for digital or virtual or interactive or SMS games is P1,000, while a service fee of 10% of gross gaming revenue is payable to the Gambling Authority. The guidelines emphasize that the Gambling Authority has zero tolerance for corruption and encourages reporting of any suspected corruption to the authority’s toll-free line.

The applications and registrations are open to persons who are interested in operating Digital, Virtual, Interactive, SMS Competitions, Games, and Quizzes where participants or members of the public will be required to pay money or other valuable consideration; via digital, virtual, interactive, and short message services with a chance to win a prize.
