Aviator LLC Drops Trademark Lawsuit Against Flutter as Both Parties Sign Content Agreement

Flutter, the international sports betting and gaming operator, has reached a settlement in the €330 million copyright and trademark infringement case brought by Georgian business Aviator LLC, after claiming the operator had infringed on its trademark by offering the popular Aviator crash game.

Aviator LLC initiated its legal case against Flutter and Spribe, the developer of the Aviator game, in August in Georgia’s Court of the First Instance. The company claimed that Spribe’s game copied its trademarked image and was therefore seeking damages.

When the case was initiated, Spribe assured the sector on LinkedIn that it had its own Aviator trademark for the game, stating: “Spribe is the creator and proud owner of the Aviator game globally, with the IP (copyright, trademark) protected worldwide and owned exclusively by us. Aviator is certified in over 40 jurisdictions and is played by more than 35 million players every month across more than 4,500 brands.”

However, Flutter was not convinced, stating that the case was “without any merit whatsoever” and planning an appeal. Aviator LLC and Flutter have since agreed to a long-term commercial deal to provide Aviator-branded games to Flutter.

As part of the deal, both parties have agreed to settle their outstanding legal dispute, according to a statement issued by Aviator LLC’s lawyer, Nikoloz Gogilidze. He stated: “As part of the deal both parties have agreed to settle their outstanding legal dispute.”

Commenting further on the deal, Gogilidze said: “Parties agreed on long-term cooperation which involves the integration of Aviator LLC’s or its affiliates games on Flutter’s platforms globally.” However, he was unable to reveal all the details of the settlement as some parts were confidential.

It is worth noting that the settlement only relates to Flutter and Aviator LLC’s case, while the dispute against Spribe is still ongoing in several jurisdictions. Gogilidze confirmed that Aviator LLC is still pursuing its case against Spribe, which relates to the use of the aviator imagery within Spribe’s crash game.

“We will soon be issuing a respective release on a status update of the said legal proceedings,” Gogilidze told iGB.
