Aviator LLC Initiates Legal Proceedings Against Betway in South Africa

Aviator LLC has initiated legal proceedings against Betway in South Africa concerning the unauthorized use of visual elements associated with the AVIATOR brand.
The action follows Betway’s response to a cease & desist notice issued by Aviator LLC regarding the use of imagery and branding elements that infringe the copyrighted AVIATOR logo.
In the interview below, representatives of Aviator LLC comment on the company’s position and its broader approach to intellectual property protection across Africa.
What led Aviator LLC to take legal action in South Africa?
The proceedings were initiated after attempts to resolve the matter through formal notice did not produce a satisfactory outcome. The dispute concerns the use of protected AVIATOR visual assets on its platform.
Protecting original intellectual property is a responsibility we take seriously, particularly in markets where the AVIATOR brand is continuing to build significant recognition and commercial presence.
CEO, George Pruidze quotes: “Our intention in engaging with partners has never been to escalate matters into court proceedings. From the outset, our priority has been to resolve matters professionally and constructively, in a manner that protects the mutual interests of all parties involved while safeguarding the integrity of the AVIATOR brand and its intellectual property rights. Unfortunately, Betway’s response and continued actions left us with no reasonable alternative but to pursue legal action.
Also important to note that this may result in an injunction restraining the infringer from further unauthorized use, together with claims for recovery of profits derived from such conduct as damages..”

Aviator LLC owns the global copyright in the AVIATOR logo and related visual identity elements. Separately, trademark rights covering the AVIATOR name and logo are held in multiple African jurisdictions by Aviator LLC and its licensed entities.
These protections exist to preserve the authenticity and integrity of the AVIATOR brand in the marketplace.
Does this action signal a broader enforcement strategy?
Yes. Aviator LLC intends to continue monitoring the market and responding where necessary to unauthorized use of its protected assets, whether through imitation of branding, copyrighted imagery, or other forms of misappropriation.
The objective is not only legal enforcement, but also long-term protection of brand value and consumer trust.
The matter will proceed through the South African legal process. While the company will not comment on specific procedural aspects at this stage, Aviator LLC remains confident in the strength of its intellectual property rights and its legal position in the matter.
