Chile Supreme Court Orders a Ban on 23 illegal SportsBetting Sites

Supreme Court of Chile has taken a significant step by ordering the restriction of access to 23 online sports betting websites, even in the absence of comprehensive laws governing online gambling in Chile. Chile 23 Sports Betting Sites Ban

The decision, which was made public on Tuesday night, is in line with a protection request made in 2022 against Mundo Pacifico by the state-owned lottery corporation Polla Chilena de Beneficencia, asking that it refrain from promoting the betting sites and limit access to them for Chilean users.

Undersecretary of the Treasury Heidi Berner unveiled a bill to control online betting sites in June. In order to effectively stop the operation of illegal gambling platforms that can be accessed from Chile, which operate without paying taxes, without a policy of responsible gambling, and without protecting children and adolescents, among other negative externalities, it seemed important to us to work on indicators to improve the design of the regulation of this activity.

The highest court in the nation approved this appeal, which had been first dismissed by the Court of Appeals of Concepción. As a result, the court has mandated that online betting sites be blocked from using Mundo Pacifico’s services.

The Supreme Court’s ruling was justified by the claim that “online sports betting is prohibited in our legal system.” It’s crucial to remember that in Chile there is still no legal restriction on internet gambling. According to the Court’s justification, websites without licenses for gambling were unlawful since they violated laws that apply to physical casinos.

The plaintiff [Mundo Pacífico] cannot transmit or promote games of chance, unless it accredits legal authorization and from the administrative authority, and therefore it must immediately block all the websites requested by the plaintiff in these proceedings.

As can be inferred from the aforementioned rules, online sports betting, such as the activity denounced by the appellant, is prohibited in our legal system, and debts incurred in such games of chance have an unlawful purpose, and those who enable such activity, as well as those who participate in it, are criminally punished.

Supreme Court Ruling

According to the Superintendency of Gaming Casinos, which regulates the country’s casinos, the only online betting services that are permitted to operate in Chile are those offered by Lotera de Concepción, Polla Chilena de Beneficencia, and Teletrak, the organizations that manage lotteries and horse racing.
