Supreme Court Ruling Empowers States to Regulate Lottery and Gaming in Nigeria

In a historic ruling on November 22, 2024, the Supreme Court of Nigeria confirmed that only states within the federation possess the authority to regulate lottery and all gaming activities.

This groundbreaking decision effectively nullified the National Lottery Act (NLA) of 2005, allowing individual states to take control of their gaming industries for the first time.

The apex court’s unanimous judgment established that matters related to lottery regulation do not fall within the Exclusive Legislative List of the 1999 Constitution (as amended). Instead, the court determined that the Houses of Assembly of each state have the exclusive jurisdiction to legislate on these issues. This pivotal ruling aligns with the principles of federalism and reinforces the constitutional rights of the states.

“This decision is more than just a victory for Lagos State; it is a landmark moment for all states in Nigeria,” a legal expert noted. “It underscores the importance of federalism and the autonomy of state governments in managing their affairs.”

Furthermore, the Supreme Court clarified that the powers of the National Assembly regarding lottery regulation are limited to the Federal Capital Territory (FCT). This limitation on federal authority represents a significant achievement for states in asserting and reclaiming their powers.

The case that led to this monumental decision dates back to 2008, showcasing the resilience and determination of the Lagos State government in its pursuit of justice and fairness. Over the years, Lagos State has advocated for its right to govern its own gaming sector, and the Supreme Court’s ruling is seen as a culmination of these efforts.
