Brazilian Court Suspends Spribe’s Aviator Trademark Registration Rights

The 18th Federal Civil Court of the Federal District in Brazil issued a ruling to suspend the trademark registration for “Aviator” held by Spribe.

This legal victory for Aviator Studio prevents Spribe from exercising exclusivity rights under Brazilian registration No. 501759803 until a final judgment is reached in the ongoing invalidation proceedings.

The court’s decision follows evidence presented by Aviator Studio Brazil demonstrating that the “Aviator” brand was established and utilized well before Spribe obtained protection in the Brazilian market. Records indicate that the brand originated in Georgia in 2016 and received formal registration there in 2018.

The Brazilian court also took into consideration previous judicial rulings in Georgia, which had already invalidated Spribe’s registration of the trademark in that jurisdiction and confirmed the rights of the original owner.

The suspension has immediate practical implications for the industry. While the case awaits a final ruling, Spribe is prohibited from taking legal action or sending threatening correspondence to operators regarding the use of the “Aviator” trademark.
